These terms govern your use of arcagen.ai and the services Arcagen provides. By using the site or our services, you agree to them. If you sign a separate agreement or order with us, that agreement controls where it differs from these terms.

Our services

Arcagen provides operations consulting, builds and runs business systems, and offers the GOAT AI Pixel, a website visitor identification product delivered with partner platforms. The scope, price, and deliverables of any paid engagement are set out in the proposal, order, or checkout page for that engagement.

Using this website

You may use arcagen.ai for lawful purposes. You agree not to interfere with the site, attempt to access systems or data you are not authorized to reach, scrape the site in a way that burdens it, or use it to send unlawful or harmful content.

If you use the GOAT AI Pixel on your website

Visitor identification is regulated differently from place to place. If you install the Pixel on a website you control, you are responsible for:

• Publishing a privacy policy on your website that accurately describes visitor identification.
• Providing any notice and obtaining any consent that applies where your visitors are located, and honoring opt-outs, including Global Privacy Control signals where required.
• Contacting identified visitors only in ways the law allows, including the CAN-SPAM Act for email, the Telephone Consumer Protection Act and Do Not Call rules for calls and texts, and applicable state privacy and marketing laws.
• Not using identified data to make decisions about credit, employment, insurance, housing, or other eligibility, or for any unlawful purpose.

You agree to indemnify Arcagen against claims arising from your use of identified visitor data in breach of these responsibilities.

Text messaging program

If you provide your mobile number and agree to receive text messages from Arcagen, these terms apply:

• What you will receive: messages about your inquiry, appointments, and our services, including follow-ups.
• Frequency: message frequency varies.
• Cost: message and data rates may apply.
• Opt out: reply STOP at any time to stop receiving messages. We will send one confirmation, and then no further messages unless you opt in again.
• Help: reply HELP, or email jamesonambrose06@gmail.com.
• Consent to receive text messages is not a condition of any purchase.
• Wireless carriers are not liable for delayed or undelivered messages.

How we handle your mobile number is described in our Privacy Policy. We never share mobile information or text-message consent with third parties for their marketing.

Fees and trials

Prices and trial terms are shown at the point of purchase or in your proposal. Where a free trial is offered, it converts to the paid plan shown at signup unless you cancel before it ends. Fees are non-refundable except where the law or your agreement says otherwise.

Intellectual property

The site, its content, and our software are owned by Arcagen or our licensors. Work we build specifically for a client is governed by that client's agreement. Nothing in these terms transfers ownership of our tools, templates, or know-how.

Disclaimers

The website and any free resources are provided "as is." We do not guarantee any particular business result, lead volume, identification rate, or revenue from our services or the Pixel. Visitor identification relies on third-party data and will not identify every visitor.

Limitation of liability

To the fullest extent the law allows, Arcagen is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the site or our services is limited to the amount you paid us in the three months before the claim arose.

Governing law

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona.

Changes

We may update these terms. Changes take effect when posted with a new date at the top. Continuing to use the site or services after a change means you accept it.
